General Terms and Conditions

(1) These General Terms and Conditions ("GTC") of CNC Hadwiger Maschinen und Anlagenservice GmbH, Am Lautstein 6, 65510 Idstein ("Seller") apply to all contracts concluded between a consumer or entrepreneur ("Customer") and the Seller via the online shop or for services.

(2) Deviating conditions of the Customer are not recognised unless the Seller expressly agrees to them in writing.

(3) These GTC also apply to entrepreneurs (§ 14 BGB) for all future business relationships.

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

(2) By clicking "Pay now" the Customer places a binding purchase offer. The Seller confirms receipt by an automated email.

(3) A contract is only concluded when the Seller accepts the purchase offer by separate order confirmation email or ships the goods.

(4) The language of contract is German. The contract text is stored by the Seller; the Customer receives a copy by email.

(1) Consumers have the statutory right of withdrawal as set out below. Entrepreneurs have no right of withdrawal.

(2) The right of withdrawal does not apply to goods made to customer specification. Software is excluded from returns.

(1) All prices are net prices in euros. Statutory VAT (currently 19%) is shown separately and is payable by the Customer.

(2) Shipping costs are not included in product prices and are shown separately during the ordering process.

(3) The Customer has the following payment options:

• Credit card (Visa, Mastercard) — via Stripe
• SEPA direct debit — via Stripe
• Prepayment / invoice for regular customers by arrangement

(4) In the event of late payment, the Seller may charge default interest of 9 percentage points (entrepreneurs) or 5 percentage points (consumers) above the base rate per annum.

(1) Unless otherwise agreed, delivery is to the delivery address provided by the Customer.

(2) Delivery times are stated on the product pages and are non-binding estimates.

(3) If a product is temporarily unavailable, we will notify the Customer immediately. In the event of a delivery delay of more than 30 days, the Customer has the right to withdraw from the contract.

(4) Risk of accidental loss passes to entrepreneurs on handover to the carrier, and to consumers on actual receipt.

(1) Statutory defect liability rights apply to our goods.

(2) Warranty claims for defects expire one year from the transfer of risk. Exceptions apply to claims for damages, fraudulently concealed defects and the right of recourse under § 478 BGB.

We exclude liability for slightly negligent breaches of duty that do not concern essential contractual obligations, injury to life, body or health, guarantees or claims under product liability law.

The exclusive place of jurisdiction for all disputes arising from this contract is our registered office, if you are a merchant.

For items supplied on an exchange basis, the old part must be returned free of charge within 8 working days. The old part must be free of burn marks, mechanical damage and repair attempts. CRT monitors must have a functioning picture tube.

For returned items, we charge an inspection and restocking fee of 10% of the goods value, minimum € 80.00 per assembly.

Please note that returns without original packaging or suitable packaging (ESD etc.) may require compensation for depreciation.

The item must be returned within 14 days of receipt by the Customer.

Software is excluded from returns!

For new customers or deliveries abroad, we reserve the right to charge a deposit equal to the difference between the exchange price and the purchase price. The deposit is refunded after return and positive inspection.

Prices apply to assemblies that can be restored with normal effort. Damage caused by external short circuits, overvoltage or customer repair attempts will be charged at actual cost.

The language of communication, both verbal and written, is German. We accept no responsibility for error-free communication in other languages.

It is the Customer's responsibility to back up data, programmes and machine parameters. We accept no guarantee for the preservation of data.
